Support for building owners and adjoining owners
Early conversations with neighbours can make the process easier before you serve a formal notice. We support both building owners and adjoining owners by providing practical guidance on what happens when they consent to or dissent from a notice. Consent may be conditional and does not remove an adjoining owner’s rights under the Act.
If an adjoining owner dissents, a party wall surveyor must be appointed to review the proposals, consider how and when the work will be carried out, and settle the relevant matters. Where appropriate, Gary Hutchinson MFPWS ACIOB can act as the agreed surveyor for both parties, helping to simplify the process.
We also prepare schedules of condition to record the neighbouring property before work starts, providing a clear reference point if damage is later alleged, and we provide clear prices for our services.
